These terms govern use of this website. Project work is also governed by the separate quote, proposal, statement of work or agreement accepted for that project.
About Bytech HQ
Bytech HQ provides custom websites, software, CRMs, business tools, automation and related consulting and support. Website descriptions and examples are general information, not a promise that any particular result, feature, timeline or price applies to your project.
Quotes, payment and project terms
Scope, deliverables, timing, fees, payment schedule, expenses, revisions, support and cancellation terms are set per project in writing. A quote is not binding until both sides accept the applicable agreement. If these website terms conflict with a signed project agreement, the project agreement controls for that project.
Your responsibilities
You agree to provide accurate information, timely feedback and content or materials you have the right to use. You may not misuse the website, try to disrupt it, probe it for vulnerabilities, introduce harmful code, impersonate someone else or use Bytech HQ's services for unlawful activity.
Intellectual property
The Bytech HQ name, site design, text, graphics and underlying site materials are owned by Bytech HQ or its licensors and may not be copied or used without permission. Ownership and license rights for client deliverables are defined in the applicable project agreement. Unless that agreement says otherwise, each party keeps ownership of materials, tools, code, methods and intellectual property it owned or developed independently before the project. You retain ownership of content and data you provide and give Bytech HQ permission to use them as needed to perform the work.
Confidentiality and data
Any confidentiality, security or data-handling obligations for a project must be stated in the project agreement. Do not send sensitive personal, health, financial or regulated information through the public website or assistant unless Bytech HQ has agreed in writing to receive it securely.
No warranties
The website is provided “as is” and “as available.” To the fullest extent allowed by law, Bytech HQ disclaims implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the website will always be available, error-free or secure. Specific warranties for paid work, if any, appear only in the applicable project agreement.
Limitation of liability
To the fullest extent allowed by law, Bytech HQ will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost revenue, lost data or business interruption arising from the website. For claims arising only from use of this free public website, Bytech HQ's total liability will not exceed $100. Liability for paid project work is governed by the applicable project agreement. Some laws do not allow every exclusion or limitation, so these limits apply only to the extent permitted.
Indemnity
You agree to defend and hold Bytech HQ harmless from third-party claims arising from content or materials you provide, your unlawful misuse of the website, or your violation of these terms, to the extent permitted by law.
Third-party services
The site or a project may link to or depend on third-party services. Bytech HQ does not control and is not responsible for their availability, security, content, pricing or terms.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute concerning only this website will be brought in a state or federal court located in New York, unless applicable law requires otherwise.
Changes and contact
